Update: Contract Works policy

On 17 October 2016, a Liquidator was appointed to the Home Australia group of companies, meeting the criteria for making a claim under a number of insurance policies relating to residential building works.

The Home Australia group includes Huxley Homes Pty Ltd (NSW), Homestead Homes Pty Ltd (SA), Collier Homes Pty Ltd (WA) and Ashford Homes Pty Ltd (VIC).

If you are a homeowner who has entered into a contract with either Huxley Homes Pty Ltd, Collier Homes Pty Ltd or Homestead Homes Pty Ltd and you have been issued with a Certificate of Insurance, for Residential Building Works, you will be covered.

Refer to your applicable policy wording for more information regarding coverage under your policy.

When submitting your claim, there are three possible manners in which it can be submitted. Our preference would be that all claims submitted be sent through email, however all three options listed are acceptable. We request that all documentation submitted be a copy as any original documentation received will not be returned.

No contract

Without a contract being signed between the parties there is no insurable event to which the policy can respond, irrespective of whether a Certificate of Insurance has been issued.

Appliances outstanding 

If you have paid the final payment under your contract and your appliances have yet to be installed, QBE will supply and install those appliances.

Homeowners need to submit a completed and signed claim to QBE. The link above will take you to our claim form. We also require copies of the following documents to accompany your claim:

  • A complete copy of the Building Contract
  • Specifications and/or variations specific to appliances, and
  • Evidence, such as a receipt or bank statement, confirming final payment was made.

If the final payment has not yet been made, then you may be able to lodge an incomplete works claim.

Incomplete works

If you have signed a contract and works have commenced, you are entitled to make a claim with QBE. As circumstances may vary from one contract to another, a completed and signed claim form for non-completion, with necessary documents attached needs to be submitted to QBE.

  • A complete copy of the Building Contract
  • Specifications
  • Any variations to the contract
  • Council approved floor, site, elevation and engineering plans
  • Receipts and/or bank statements evidencing all payments made under the contract to the contracting builder
  • Photos substantiating the stage of construction at the time your builder ceased construction.
  • Contract Balance Reconciliation

Works not yet commenced

If you have signed a contract, but works have not yet commenced, you may be entitled to claim a refund of your deposit paid to your builder under the contract.

Homeowners need to submit a completed and signed claim form to QBE. The link above will take you to our claim form.

Copies of the following documents need to accompany the claim form:

  • A complete copy of the Building Contract, and
  • Evidence, such as a receipt or bank statement confirming payment of the deposit.

Defects

QBE will assess and rectify any claim received for defects if a breach of statutory warranty has occurred, resulting in a loss.

To ensure an accurate assessment of your defect claim, we request that you provide a clear description under Section 8 of the claim form of each item being claimed. Should you have any photos of the items being claimed, please also attach them to your claim form.

Question & Answers

Q. Do I have to pay an excess?

A. Yes. As with most insurance policies, an excess does apply and you should refer to your policy wording for details on the applicable amount. This is generally deducted at the time of settlement.

Q. I am due to pay the next progress payment. What should I do?

A. You may be obliged to pay for work that has been completed at the time Housing Australia Group Pty Ltd went into liquidation. The amount due, including any surplus, will be established during the claims process. 

Please seek legal advice before making any further payments as any over payments to a contract could affect any potential settlement of an insurance claim.

Q. Can I get my own quote? 

A. If you are lodging a claim, we encourage you to obtain your own quotations as this can speed up the claim process. A minimum of two to three quotations are normally required for comparison reasons.
