Workers Compensation Insurance

Who needs a workers compensation insurance policy?

It is compulsory for any employer in NSW to take out a workers compensation insurance policy if:

  • the total annual remuneration paid by you as an employer exceeds $7,500; or
  • the total annual remuneration paid by you as an employer is less than $7,500 and you employ an apprentice or trainee, or you are a member of a Group of companies for Workers Compensation purposes.

If you fit the above criteria and do not take out a workers compensation insurance policy, penalties could apply.

Who isn't covered?

If you are a NSW employer paying annual wages of $7,500 or less, you are no longer able to obtain a workers compensation insurance policy unless you employ an apprentice or trainee, or if you are a member of a group of companies for workers compensation purposes. (Effective from 30 June 2008.)

This includes private householders employing domestic staff and paying $7,500 or less in annual wages.
